Copyright Holders and Users Should Be Treated Equally, VEB.RF’s Deputy Chairman Urges

Copyright holders and users should be given equitable treatment. This was stated by VEB.RF Deputy Chairman Igor Drozdov, speaking at Russian International Creative Seasons.

According to him, failure to put such mechanisms has led to an imbalance that allows copyright holders to misuse their position. “Intellectual property rights are associated solely with the interests of copyright holders. And now we see that sanctions can be used to disable anything on the pretext of protecting intellectual property in relation to not only intangibles but also tangibles. In this instance, users must be treated fairly,” Igor Drozdov said.

Ownership today is no longer limited to being in physical possession of an item, and purchasing a product does not guarantee that it will not become unserviceable at any time, he said. An example given by VEB.RF’s Deputy Chairman was Western automotive companies preventing Russian car owners from using their software. It is, therefore, equally necessary to associate intellectual property rights with the interests of users and protect such interests legislatively, according to Igor Drozdov.

“We could only theorise about it before 2022, but now we see the real consequences. And we should respond, of course. […] There must be protection from what can be unfairly done by the copyright holder. We have no such mechanisms at the moment. Even if you refer to our legislation on technological protection measures, they are applied unilaterally,” said VEB.RF’s Deputy Chairman.

In addition, he noted the importance of keeping a balance between copyright protection and the ability to freely distribute content using artificial neural networks.

“From a legislative perspective, the main problem today is the copyright status of artificial intelligence–assisted works. There is no clear regulation in this area. We do not have any at all, but other jurisdictions are trying to clarify the issue. Copyrighted material is increasingly used for content created and provided by neural networks, while human authors receive no compensation,” Igor Drozdov said in conclusion.⁠
